Get the picture: privacy in the smartphone era

Our instincts on what our rights should be are surprisingly out of whack with what the law demands, but privacy advocates say we should become more aware, and protective of, our ‘gateway’ rights

Did you realise you don’t automatically own your own image? If you’re in a public place, even if you’re with your kids, anyone can take your picture and you have no automatic right to stop them.

Likewise, just because you’re in a photo doesn’t mean you have any say in how that picture is used. Ask the average member of the public if this seems right and the odds are they’ll say it’s not.
