Setback for Ireland in €13 billion Apple tax case as ECJ advocate general sides with Commission

In a significant setback for the Irish government and Apple, the ECJ’s advocate general has said the EU’s general court should reopen the case

The advocate general of the European Court of Justice (ECJ) has said the EU’s General Court made a “series of errors in law” when it overturned the European Commission’s finding in 2016 that Apple received illegal state aid from the Ireland between 2003 and 2014, and that the US tech giant owes the Irish exchequer more than €13 billion in unpaid taxes.

In what amounts to a significant setback for the Irish government and Apple, the ECJ’s advocate general has said the EU’s general court should reopen the case and issue a new assessment on the long-running Apple tax case.
