Potentially damaging prosecution evidence, including an email sent by a subordinate at Anglo Irish Bank, was excluded from the retrial of former bank executive Tiarnan O’Mahoney.

The 58-year-old, once a leading light at the collapsed lender, was last week acquitted by direction of the judge of conspiring to destroy or falsify records of accounts connected to the bank’s former chairman Sean FitzPatrick. The retrial at Dublin Circuit Criminal Court lasted 21 days.
