Employers that do not engage in collective bargaining may be brought before the Labour Court for the investigation of a trade dispute.
The Industrial Relations (Amendment) Act 2001 put in place a mechanism whereby the Labour Court can consider trade disputes (concerning the terms and conditions of workers), and make initial recommendations, followed by legally binding determinations, resulting from this consideration.
