It was received wisdom back a few weeks ago that Máire Whelan would bow out of her advisory role to the government and fill the vacancy in the Court of Appeal. A controversial figure in the wake of the Fennelly report and by no means the most popular attorney general in memory, this was one way of leaving an unstable government before the rules on judicial appointments were tightened up.
