In defence of the Section 110 tax code

It’s been used by vulture funds and private equity to drive down tax bills – but tax lawyer William Fogarty argues that an excessive focus on tax and Section 110 could reduce lending to Irish businesses

There is a material difference between tax avoidance and merely using the tax code in exactly the manner in which it was intended. Governments use the tax code to incentivise behaviour. At an individual level, taxpayers are encouraged to save for their retirement through tax relief on their pension contributions.
