John McCabe, one of the state's largest builders, sought to prevent the National Asset Management Agency (Nama) from appointing a receiver to his business, arguing that certain loans were subject to "current criminal proceedings".

McCabe's claim relates to the so-called Maple 10 transaction, when ten long-standing clients of Anglo Irish Bank, including McCabe, secretly bought a 10 per cent stake in the bank.
