Litigants face unnecessary bills for cases

Litigants could face bills of up to €7,000 for un necessary court applications, following a decision by the High Court.

The president of the High Court, Mr Justice Joseph Finnegan, ruled that the Master of the High Court had no power to make a ‘‘wasted costs’’ order against a solicitor. The decision has been welcomed by the Law Society, which represents solicitors.

The ruling related to High Court proceedings taken by Terence Kennedy after an accident at work. Senior counsel advised Kennedy’s solicitors to write to the company seeking an admission...
